Our General Terms & Conditions 

 

STORYSCAPE TRAVEL GENERAL TERMS & CONDITIONS FOR TOURS & BREAKAWAYS TAKING PLACE IN SOUTH AFRICA BY SADC RESIDENTS

Any Terms and Conditions or part-thereof which may differ from these standard StoryScape Travel Terms, will be included with the StoryScape Travel quote, and will take preference.

  1. INTERPRETATION Except where the context otherwise dictates the following words and phrases bear the following meanings: “the client”: the person or persons for whom the tailor-made itinerary is prepared. “Force majeure event”: an event beyond the Tour Operator’s controls which in terms of the common law excuses non-performance, or delayed or reduced performance, by the Tour Operator. “Tour”: a tour, daytrip, breakaway, safari, or combination of them, described singularly or in combination in the bespoke or tailor-made itinerary. “The Tour Operator”: StoryScape Travel (Pty) Limited (Registration number 2019/218910/07).1.1. Headings herein are for guidance only and are not a part of this agreement1.2. References herein to a gender include both the others; and references to the singular include the plural and to a natural include a juristic person and vice versa in each case.
  2. ACCEPTANCE OF BOOKINGS; GENERAL TERMS 2.1. No contract between the Tour Operator and the Client shall come into existence unless and until the Client has paid a 20% deposit of the full published Tour price. Upon payment of a deposit Client will be deemed to have accepted these Terms & Conditions.

2.2. Acceptance of these Terms & Conditions by the Client will only be valid once a deposit of 20% has been received by the Tour Operator.

2.3. A single person booking and choosing to make payment on behalf of his/her ‘group’ will be accepting the Terms & Conditions and shall be deemed (notwithstanding lack of actual authority, if this is applicable) to be accepting them on behalf of all persons participating in the applicable tailor-made, bespoke or standard published Breakaway, Tour or Itinerary and is responsible to ensure that all such persons are aware of these conditions.

2.4. No variation (unless specially and specifically communicated in writing / email) of these conditions shall be of any force or effect, and no person representing the Tour Operator other than a Director or equity-holding member of the Tour Operator has authority to assent to such a variation.

2.5. These conditions and all other matters arising from the contract between the Client and the Tour Operator are governed and are to be interpreted according to the law of South Africa and subject to the exclusive jurisdiction of the South African courts.

3. POSTPONEMENTS (not cancellation) OF TOURS / BREAKAWAYS & ACCOMMODATION

3.1 The Client may change the Tour / Breakaway dates, based on published availability within 7 days of making any booking with no repercussions or financial penalties. Should the new chosen dates have a published price difference then the difference in price will be charged to the Client.

3.2 Having booked and paid the deposit, the Client may change the booking 45 days prior to the start date of the already booked Tour or Breakaway, to another future available date, free of charge and without any repercussions or financial penalties. Second and subsequent date changes will incur a 10% re-booking fee (10% of the total Tour / Breakaway fee invoiced).

    4. ALTERATIONS TO PRICE AND SERVICES

    4.1. The Tour Operator may make minor changes to any tour without any right of compensation to the Client. Major changes such as, without limitation, major alterations of the itinerary, overnight stops, destination, or timing, may be affected by the Tour Operator at its discretion for reasons
    of safety, convenience, a force majeure event, accident, or breakdown (subject to 5.3 below)

     

    5. LIMITATION OF LIABILITY

    5.1. The Client acknowledges that the Tour Operator’s liability for loss of or damage to the Client’s property or for personal injury to or death of the Client (or any minor child or person under any disability upon whose behalf, whether as parent, in loco parents, as guardian, or howsoever, a Tour / Breakaway is booked by the Client) is limited to those liabilities against which the Tour Operator is obliged to be insured (and against which it warrants that it is insured). Specifically (but without limitation) the Client’s attention is drawn to the fact that the limit of insurance (and thus liability) for any injury to a passenger caused by or attributed to the Tour Operator is (in the aggregate and regardless of the number of claims encompassed) R5,000,000.00 per incident. The Tour Operator’s insurance will be furnished upon request.

    5.2. Additionally to, and without derogation from, clause 6.1 above, the Tour Operator is liable only for losses, damage and personal injury suffered or sustained by the Client in the course of services provided by the Tour Operator in the course of a Tour / Breakaway and caused by or attributable to the Tour Operator, which services do not include the provision of accommodation, sightseeing tours and other services of any nature provided by third parties, which said third parties are independent of the Tour Operator. In securing for the Client bookings for services provided by such third parties the tour Operator takes no undertaking nor gives any warranty as to the provision of any services or goods, accepts no liability for any failure to provide the same, and does not indemnify the Client against any loss, damage or injury caused by or attributable to such third parties.

    5.3. In no circumstances will the Tour Operator be liable for any consequential damages, or to any extent beyond the cost of a tour, because of cancellation or major alteration of that tour, even if such cancellation or alteration occurs by reason of fault of or attributable to the Tour Operator.

    We only ask for personal information when we truly need it to provide a service to you. We collect it by fair and lawful means, with your knowledge and consent. We also let you know why we’re collecting it and how it will be used.

    We only retain collected information for as long as necessary to provide you with your requested service. What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.

    We don’t share any personally identifying information publicly or with third-parties, except when required to by law.

    Our website may link to external sites that are not operated by us. Please be aware that we have no control over the content and practices of these sites, and cannot accept responsibility or liability for their respective privacy policies.

    You are free to refuse our request for your personal information, with the understanding that we may be unable to provide you with some of your desired services.
